Citation Appeal Process
If you wish to contest a parking citation, you may appeal the parking citation by submitting a Citation Appeal Form within 21 calendar days from the date of the parking citation or 14 calendar days from the mailing of the notice of delinquent parking violation (Section 40215 of the CVC). The appeal request is for citation review only. Submittal of this request does not mean that your citation will be automatically dismissed. Your request will be carefully reviewed and you will be notified by mail of the disposition of your request. During the review process, the citation will be suspended pending the result of the review.
Please allow 7-10 business days for the review process. A postcard with the disposition will be mailed to the address provided on the appeal. If you do not receive the postcard in the mail within a reasonable amount of time, it is your responsibility to call (805) 546-3205 or come by the Campus Police Dept. to check on the result. A late fee will be added to the fine if not paid within 30 days of issuance. Non-payment of the citation may result in a hold being placed on your DMV record. This hold will not allow you to register your vehicle until the citation is paid. How to pay citation
If you are dissatisfied with the results of the initial review, you may request an Administrative Hearing of the violation no later than 21 calendar days following the mailing of the results of the initial review. The Administrative Hearing Request form is available online or you may pick-up a paper copy at the Campus Police office. Upon requesting an administrative hearing, you must deposit the amount of the parking penalty with the completed paperwork. If the citation is dismissed, the deposit will be given back to you. If the deposit is a financial hardship, complete the Financial Disclosure form to show satisfactory proof of an inability to pay the amount due. The hearings are held once a month. A letter will be mailed to you at the address provided with a date and time to appear for the hearing. The hearings are conducted at the Campus Police office in Building 6600A on the San Luis Obispo campus.
You have the right to appeal the final determination of the Hearing Officer to the San Luis Obispo Superior Court within thirty (30) days of the mailing date of the result of your hearing. A $25 court filing fee will be required by the Superior Court. This filing fee will need to be deposited with the court. If the citation is upheld, the citation fine will be retained by Cuesta College and the court filing fee will be retained by the Superior Court. Both payments will be returned to you if the court dismisses your citation.
